We represented former Key President Jim Beyerlotzer, CFO Tom Grundman and Division Manager Joe Eustace in their claims that Key had improperly wiped out their stock options by becoming de-listed through their own fault. Each held Millions of dollars of stock options, which expired because Key was blocked from trading during a lengthy restatement of its books and records. In two of the three cases resolution was reached by agreement, and in the third trial was required in which we prevailed.  In the process, we accumulated expertise in the way ESOPs work and the law around them.

“Tom and his group were the most thorough, well prepared attorneys I have worked with in over 30 years. Hopefully, I will never need the services of a top attorney again but if I do, Tom is the best I know of.”

President, Pioneer Drilling

“Working with Tom Fulkerson and his team is a great experience. In my opinion, he is unique in his field; Tom combines a commanding, in-depth knowledge of the law together with a business person’s understanding of the specific issues. He is tough, savvy, accessible and keen on the details. Tom is not only a trusted advisor but has become a good friend.”
