The NGC Settlement Trust was established in 1993 to aid victims of asbestos produced by National Gypsum. In 1998-2001 we worked extensively with its trustee, Mr. W.D. Hilton, to pursue its $650 million claim that NGC’s management intentionally undervalued the company in bankruptcy so as to avoid sharing that benefit with creditors.

“Tom Fulkerson represented a relatively small trust in a fraud case against some of the titans of the world of distressed asset investing during a bankruptcy. His ability to strategize, implement that strategy and litigate the matter in a courtroom setting was outstanding. He worked very hard in the development of complex strands of evidence through both document review and depositions. Tom clearly articulated the position of the Trust in settlement negotiations and ultimately resolved the case. We were pleased with both the outcome and the timing.”
